Welcome to Hydrofiltrr. These Terms of Service ("Terms") govern your access to and use of our website located at hydrofiltrr.com (the "Site"), including any content, functionality, and services offered on or through the Site (collectively, the "Services"). The Site and Services are operated by Hydrofiltrr, a business located in Gold Coast, Queensland, Australia ("we," "us," "our," or "Hydrofiltrr").

By accessing or using the Site or Services, placing an order for products through the Site, or otherwise engaging with us, you agree to be bound by these Terms, our Privacy Policy, Shipping Policy, and Return and Refund Policy (collectively, the "Policies"), which are incorporated herein by reference. If you do not agree to these Terms or any of the Policies, you must not access or use the Site or Services.

We reserve the right to update, change, or replace any part of these Terms by posting updates and/or changes to the Site. It is your responsibility to check this page periodically for changes. Your continued use of or access to the Site following the posting of any changes constitutes acceptance of those changes.

1. Eligibility and Account Registration

To use certain features of the Site or Services, such as placing an order, you may be required to provide personal information (e.g., name, email address, shipping address). You represent and warrant that: (a) all required registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; and (c) you are at least 18 years old or the age of majority in your jurisdiction, whichever is higher, and have the legal capacity to enter into these Terms.

We do not require user accounts for basic browsing or purchases, but if you choose to subscribe to newsletters or create a saved profile for faster checkouts (if available), you are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to comply with these obligations.

2. Products and Orders

All products displayed on the Site ("Products") are offered subject to availability. We reserve the right to discontinue any Product at any time without notice. Descriptions, images, and specifications of Products are provided for informational purposes only and may be updated or corrected without notice. While we strive for accuracy, we do not warrant that Product descriptions or other content on the Site is error-free, complete, or current.

By placing an order, you are making an offer to purchase a Product, which we may accept or reject at our sole discretion. We will confirm acceptance by sending you an order confirmation email. If we cannot fulfill your order (e.g., due to stock issues), we will notify you and provide a full refund.

Prices for Products are listed in Australian Dollars (AUD) and include Goods and Services Tax (GST) where applicable. Prices do not include shipping fees, which will be calculated and displayed at checkout. We reserve the right to change prices at any time, but changes will not affect orders already confirmed.

3. Payment

We accept payments through secure third-party payment processors, such as those integrated with Shopify. By providing payment information, you represent and warrant that you are authorized to use the payment method and that you authorize us (or our payment processor) to charge the full amount, including any applicable taxes and shipping fees.

All payments are processed in AUD. If your payment method is in a different currency, your bank or payment provider may apply foreign transaction fees or currency conversion charges, for which we are not responsible.

In the event of a payment dispute, you agree to provide us with any necessary information to resolve it. We may suspend or cancel your order if payment is not received or if we suspect fraudulent activity.

4. Shipping and Delivery

Please refer to our Shipping Policy for detailed information on shipping methods, times, costs, and restrictions. We ship primarily within Australia from our Gold Coast warehouse. Delivery times are estimates only and may be affected by factors beyond our control, such as carrier delays, weather, or customs (for any future international shipping).

Risk of loss and title for Products pass to you upon delivery to the carrier. We are not responsible for lost, stolen, or damaged packages after handover to the carrier, though we will assist with claims where possible.

5. Returns, Refunds, and Exchanges

Our Return and Refund Policy details your rights regarding returns, refunds, and exchanges. In summary, we comply with Australian Consumer Law (ACL), which provides statutory guarantees for Products, including that they are of acceptable quality, fit for purpose, and match descriptions.

For change-of-mind returns, we offer a 30-day window for unused, unopened Products, subject to conditions outlined in the Policy. Faulty or defective Products will be handled in accordance with ACL requirements.

6. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, images, product descriptions, videos, software, and compilations (collectively, "Content"), is the property of Hydrofiltrr or its licensors and is protected by Australian and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Content solely for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any Content without our prior written consent.

Our trademarks, including "Hydrofiltrr" and "PuraRush," may not be used in connection with any product or service that is not ours, in any manner likely to cause confusion.

7. User Conduct and Prohibited Activities

You agree to use the Site and Services only for lawful purposes and in accordance with these Terms. You must not:

- Use the Site in any way that violates any applicable federal, state, local, or international law or regulation.
- Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site, or which may harm us or users of the Site.
- Use any robot, spider, or other automatic device to access the Site for any purpose, including monitoring or copying Content.
- Introduce any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
- Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site, the server on which the Site is stored, or any server, computer, or database connected to the Site.
- Use the Site to transmit, or procure the sending of, any advertising or promotional material without our prior written consent.

We may terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason, including if you breach these Terms.

8. User-Generated Content

If the Site allows you to submit reviews, comments, photos, or other content ("User Content"), you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media.

You represent and warrant that: (a) you own or control all rights in and to the User Content; (b) the User Content is accurate; and (c) the User Content does not violate these Terms or any third-party rights.

We are not responsible for User Content and reserve the right to remove or edit it at our discretion.

9. Disclaimer of Warranties

To the fullest extent permitted by law, the Site and Services are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

We do not warrant that: (a) the Site will function uninterrupted, secure, or available at any particular time or location; (b) any errors or defects will be corrected; (c) the Site is free of viruses or other harmful components; or (d) the results of using the Site will meet your requirements.

Under Australian Consumer Law, certain statutory guarantees apply that cannot be excluded. Nothing in these Terms affects those guarantees.

10. Limitation of Liability

To the fullest extent permitted by law, including under the Australian Consumer Law, in no event shall Hydrofiltrr, its affiliates, officers, directors, employees, agents, suppliers, or licensors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the Site or Services.

Our total liability to you for any claim arising out of or relating to these Terms or your use of the Site or Services shall not exceed the amount you paid us for the relevant Product or Service in the twelve (12) months preceding the claim.

If any limitation or exclusion of liability is held to be invalid or unenforceable, our liability will be limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Hydrofiltrr, its affiliates, officers, directors, employees, agents, suppliers, and licensors from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from: (a) your violation of these Terms; (b) your violation of any law or third-party rights; or (c) any User Content you submit.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Queensland, Australia, without regard to its conflict of law principles.

Any dispute arising out of or relating to these Terms or the Site shall be resolved exclusively in the courts located in Queensland, Australia. You agree to submit to the personal jurisdiction of such courts.

13. Miscellaneous

- Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
- Waiver: No waiver of any term shall be deemed a further or continuing waiver.
- Assignment: We may assign these Terms without your consent. You may not assign these Terms without our prior written consent.
- Entire Agreement: These Terms, together with the Policies, constitute the entire agreement between you and us.
- Force Majeure: We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages.
